The case was resolved after the Defendant’s Daubert motions to bar the Plaintiff’s experts from testifying that the Pilot’s multiple myeloma was caused by exposure to the diesel exhaust, which contains numerous carcinogens, including benzene, was denied.

Because the plant operator failed to have a safe lock out tag out procedure, a sluice gate was left open during the dive causing the diver to be sucked into the open gate due to differential pressure. After being sucked in, the plant operator then attempted to close the gate, nearly crushing the diver.

    Bloomfield & Katz obtained a $300,000 settlement, from the U.S. Army Corps of Engineers, for a mate who was injured when a shackle broke off from a federal mooring cell and struck the mate in the leg. The mate was assisting the crew in tying off to the mooring cell so the vessel could wait its turn to pass through Pickwick Lock.

  • $190,000+ Jury Verdict Against Car Dealer for Husband and Wife Injured in Hit and Run Motor Vehicle Accident

    Brian S. Katz obtained a jury verdict in excess of $190,000 against a car dealership after the jury found that the dealership still owned the vehicle used in a hit and run. The dealership had failed to properly deliver title to the purchaser who was involved in the hit and run, and therefore still retained ownership of the vehicle.
